An ICE bond (also known as an immigration bond) is a type of bail bond used when someone is detained by ICE (Immigration and Customs Enforcement). It allows the immigrant arrested to be released from custody while they wait for their immigration court hearing.
Here’s how an ICE bond works:
- Who qualifies?
Not everyone is eligible. ICE or an immigration judge decides if the person qualifies for a bond based on factors like:- Criminal history
- Flight risk
- Danger to the community
- Ties to the U.S. (family, job, etc.)
- Bond amount:
ICE or the judge typically sets the bond amount, which can range from a few thousand dollars to tens of thousands of dollars. The more flight risk, the higher the bond. - Paying the bond:
There are two main ways to pay:- Cash bond: A friend or family member pays the full amount directly to ICE.
- Surety bond: A licensed immigration bail bond company (like Speedy Immigration Bail Bonds) pays the bond in exchange for a fee (usually a percentage of the bond amount).
- After release:
The immigrant is released from detention but must attend all court hearings and comply with immigration orders. - Refund:
If a cash bond was paid and the immigrant follows all court instructions, the bond money is refunded (after the case is closed). If they miss court or violate conditions, the money is lost.
